2 year old son was abused at daycare - offending teacher is gone, but can/should we take further action?


I have a 2 year old son and a 4 year old daughter both attending the same daycare center for the past year and a half. Last fall they hired a new teacher for the toddler room. Just a week or so ago we were told by the director that the teacher had been abusing some of the children. She wasn't doing anything to cause injury, but she was being too rough with some of the kids, including my son.The worst part of all this is the other teachers reported her several times, and the director continued to give her warnings but didn't fire her until the 5th incident.The kids are both still there and both are doing fine. Last incident and firing was about 2 months ago, but we didn't learn the details until recently because the director was caring for her sick mother. We're kind of stuck there because of cost and waiting lists.My wife thinks we should ask that they reimburse us for our son's tuition during the time the abusive teacher was there. Does that seem reasonable? Is it weird to ask this when we're keeping our kids in the center? We don't want to put the place out of business... my wife assures me that they have insurance that can cover this sort of thing.Meanwhile, the state is investigating what happened. Director tells us there will be a mark on the center's record for 10 years. She's angry at herself for letting it go so long and I think she is genuinely remorseful. I think her focus lapsed because of her mom.Is this the sort of thing where I need to just talk to a lawyer?
