autism and sleep problems that we can't control

I have a 4 year old daughter with autism. She was diagnosed at 18 months old and its on the more severe side, we lucked out and sleep was never a problem for her. She gets melatonin nightly and its worked out well for us as a family.Heres were the problem comes in, our upstairs neighbor has a son with aspergers. Between 10-12 years old we think. His mom goes to work at 1am leaving him home alone and awake (I don't know why hes awake, but he is) He stomps up and down the halls waking up our daughter in a fit of absolute terror. Once we get her to calm down; guess what? shes awake for the day and miserable. We can't just give her more medication... for us personally thats just unethical. Before we discovered his diagnosis, we talked to him twice.... it didnt stop until we managed to corner the mom and tell her, she had no idea what was happening. He didnt even tell her we had talked to him at 2am twice. It stopped for a few days and now its started back up again.... we, to tired to cope, called the police. Hopefully it doesnt happen again tonight, but we will call the police again if it does. Chances are though, his mother doesnt even know the police were there last night. (havent seen her today to tell her what has been happening, the woman seems to never be home, but the kid almost always is)My daughter is missing out on school, therapies... this is effecting her brain development after working SO HARD to find a school system that works for her, it seems like its being flushed down the toilet over something we cant control! Shes 100% non verbal and being basically harassed! I am at a loss of what to do. Obviously this kid can't handle being home alone.... anyone know of the legalities of this situation? via /r/Parenting http://ift.tt/2xZTDEZ
