Paid Parental Leave


My husband and I are currently facing a confusing situation at work so I thought I would reach out and see if anyone has faced something similar...We both work for the same company, we'll call it company A. Under Company A's parental leave policy, Maternity leave was 8 weeks paid, plus short term disability and the paternity leave was 8 weeks paid.We recently got bought out by a larger company, Company B, and have been told we are switching to Company's B's parental leave policy as of Jan 1st 2020 (our baby is due Jan 25th 2020)Company B's policy is 10 weeks paid leave for the Primary Caregiver and 2 weeks paid leave for the Secondary Caregiver. (short term disability would be available to me in addition to the paid leave)We are both planning on returning to work after leave, and we decided between us, since my husband has a higher salary that he would be the primary caregiver so we could have longer leave with the higher pay. Our HR is now telling us that they will decide who is primary and who is secondary based on "documentation" (haven't gotten clarity on what that is)We're concerned they will try to force the "primary caregiver" status on me, since I'm a woman. We've seen the articles about JP Morgan losing a lawsuit to discrimination in such instances but everything we've seen online so far has been about a single parent working at a company.
