
I have a question about a new contract from my current day care provider. I'm not sure if it's reasonable or not. Personally I don't think it is, but I would like some input from the community, even if you do think it's reasonable. The contract can be found on my imgur account as it is several pages long.http://ift.tt/2E1iV6z a question for everyone… Does anyone find the following contract reasonable for a daycare provider?Before I get to the actual contract maybe a little background on the story is required.My wife and I have been sending our daughter to the same daycare for about 3 years and we’ve never had a problem… Until now that is. My schedule is 7 AM – 5 PM Monday through Friday. I have a 30 minute drive to work, and so I have a 30 minute drive home from work. I usually can’t get the children before 5:45 PM. I’m a custodian and I refuse to hold my infant daughter while I’m covered in the germs that I’ve accumulated throughout the day. So I get home, I shower, I get the kids. This has been my schedule during the school year, in the summer it’s 7 AM – 4 PM. This is how it’s been for the last year and a half, and will be for the foreseeable future.We’ve been having issues with our DC lately as she has become increasingly unreliable. In January alone, she worked only 1 full week, and even than it was begrudgingly. We’ve had reliability issues with her in the past but it seems to be more of an issue lately than ever before.She recently dropped this new updated contract on us and we can’t help but feel it’s unrealistic in its expectations of us as parents. I’m no expert, so I’m asking anyone with any insight to let me know how reasonable this contract might be. Over the summer my wife and I had a second child, our rates went up accordingly, in fact we were getting a pretty good rate considering one of our children is an infant. Currently, until the new contract goes into effect in March, we pay $200 a week ($400 per pay period).Under the new contract, we are expected to pick up our children no later than 5 PM, which our DC knows for a fact is not doable by my wife or myself. The late fees and over time will increase our daily rate to $292. That’s $2,920 per pay period. These rates go up because we would be getting hit with “Overtime” fees, on top of “Late Fees” that eventually result in her being payed $3/minute.She asks for 20 paid days off + 1 week of vacation equaling 25 paid days off a year (ALMOST AN ENTIRE MONTH). Some of the paid days off are holidays, no problem, but 5 of them are seemingly random days that are not associated with anything. She mentions nothing about sick days or how many she is allowed, or how many sick days parents are expected to pay for, so in reality she can close at any time (which she already does) with no repercussions or penalty to herself.She requires 3 weeks notice of contract termination and all fees paid up front at time of written notice. So, to terminate our contract we need to pay UP FRONT a minimum of $600, but could be as high as $4,380 when taking into account late fees and over time. The contract also says that she will sue any parent that doesn’t pay in a timely fashion. Not only will she sue for that $600 - $4,380 the parents must also agree to pay her for a lawyer and assume all legal costs. It also says she will sue for defamation of character if someone says something bad about her over social media (assuming the claim can’t be proven, or is false).She claims this contract is not targeted at my wife and I, though we are one of only 2 families that CAN NOT pick up before 5 PM.Does ANY of this contract seem reasonable? via /r/Parenting http://ift.tt/2E20faQ
