Height or age for moving from the booster seat?


My state has an unusually strict height requirement for allowing a kid to be moved from the booster seat. The law states that a child can be removed from the booster seat at age 8 or when they reach 57 inches. It's a whichever comes first kind of deal.For most kids I am sure 8 comes first. I'm an adult woman and am barely above 57 inches myself. My oldest son has inherited his mama's genes and is nowhere near that height and won't be anywhere close by the time he turns 8. He's 7 and goes to a PK through 12 school and is routinely mistaken for a preschooler. Most people think that he and his preschool brother are twins. Since he'll meet the age requirement I can legally move him on his 8th birthday, but is it safe if he is the size of a much younger child?
