I live in Michigan. The CPS showed up at my house on Friday with the information that an allegation had been against my household for being hoarders and a fire hazard to my children. I spoke with them briefly and recorded the entire conversation. It was alleged that our house is full of stuff and there are only 2 foot paths throughout the house. I asked if the allegation were made by someone who has stated they have been in my house, they said it was not a part of the allegation. I can assure you, that the person making the allegation has never set foot in my house since we owned it with our permission. I told them I am using my right to remain silent when asked about the condition of the house and told them I would not allow them into my home without a warrant or court order to protect our right to privacy. I let them look at my children, but told them they were not allowed to interrogate them without a lawyer present. They requested we take our children for a wellness checkup to make sure they are healthy. I am actually about to go to the ER after I type this as the ER is the only place that will do it on a weekend. I was told on Monday, CPS would contact the district court to further the investigation. I have no problem with that, as I 100% believe there are no Safety Factors in our home. We try our best to not allow anyone that is not a friend or family into our home due to my special needs daughter. She has a number of specialist and suffers from sensory issues, has speech apraxia, and suffers from both complex and partial seizures. She had her longest seizure of her life last week that resulted in an overnight stay at the hospital. Because of her sensory issues, she is very combative when she has to let a doctor look at her let alone when she needs an EEG. She has finally calmed down this week, and I know this will be very upsetting to her. This is the main reason we do not just allow people into our homes. This is her safe place where she can feel comfortable and knows what she can expect. We even do not allow certain medical tests/treatments in certain rooms as we want her to never associate any stressors in those rooms. Has anyone had to appear before the district court? How do you address the judge or whoever proceeds over it. I can explain why we do not let people in, but I do not want to get drilled on why I would invoke my 4th and 5th amendment rights. Should I call them up and see if we can schedule when they view my house versus waiting for a court order or warrant? I also believe that the reporter is a malicious reporter. They have filed the same complaint (worded nearly the same way) with any agency that is required to respond to a claim. The police have stopped coming here almost 8 years ago as they have handled enough false claims from them. The police have said there is nothing we can do. I believe that there is a counter claim that we can request from the CPS, but I cannot find any other information on it. via /r/Parenting http://ift.tt/2nnAveT
